1. Service Performance and Quality
Service Verification
Upon completion of services, HouseCare will document all work performed, including:
- Tasks completed
- Materials used
- Recommendations for future maintenance
- Photos or videos of completed work (when applicable)
- Time taken for service
Warranty
HouseCare warrants all services performed for 90 days from the date of service. This warranty covers defects in workmanship and materials used. This warranty excludes damage caused by customer misuse, abuse, or circumstances beyond HouseCare's control.
2. Payment Terms
Service Fees
The customer agrees to pay fees as outlined in the main agreement for all services performed. Fees for base service and selected packages are payable in advance, either annually or in monthly installments.
Additional Services
Services not included in your package will be quoted separately. HouseCare will present a written quote for any additional services prior to performing work, and the customer must provide written approval before work commences.
Late Payments
Payment is due upon receipt of invoice. Payments not received within 30 days will be subject to a late fee of 1.5% per month or the maximum allowed by law, whichever is less.
3. Termination
Termination by Customer
The customer may terminate with 30 days' written notice. If the customer has prepaid for services not yet performed, HouseCare will refund the prorated amount, less any applicable early termination fee.
Termination by HouseCare
HouseCare may terminate with 30 days written notice if:
- Customer fails to pay any amount when due
- Customer breaches any other material obligation
Immediate Termination
HouseCare may terminate immediately if the customer or any person at the property engages in abusive, threatening, or unsafe behavior toward HouseCare personnel.
4. Limitation of Liability
HouseCare's liability for any claim shall be limited to the amount paid by customer for the specific service giving rise to such claim.IN NO EVENT SHALL HOUSECARE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES.
5. Insurance and Legal
Insurance
HouseCare maintains general liability insurance with coverage limits of at least $1,000,000 per occurrence and $2,000,000 aggregate, plus required workers' compensation insurance.
Independent Contractor
HouseCare is an independent contractor and not an employee or agent of the customer.
Subcontractors
HouseCare may engage qualified subcontractors to perform specialized services while remaining responsible for all work performed.
Assignment
Neither party may assign this agreement without prior written consent of the other party.
Governing Law
This agreement is governed by the laws of the state where the customer's property is located. Disputes will first be addressed through good faith negotiation, then mediation if necessary.
Entire Agreement
This agreement, including all supporting documents, constitutes the entire agreement between parties and supersedes all prior agreements or communications.
Modifications
This agreement may only be modified by a written amendment signed by both parties (except communication preferences, which may be updated by customer at any time).
